Welcome to the HEBeauty360°.com website (the "Site"). These terms and conditions ("Terms and Conditions") apply to the Site. HEBeauty360° means J-Glitz Enterprise a sole proprietorship incorporated in Malaysia under registration number 002282836-X and having its register address at USJ 6, Subang Jaya, Selangor, Malaysia.
By accessing the Site, you confirm your understanding of the Terms and Conditions. If you do not agree to these Terms and Conditions of use, you shall not use this website. The Site reserves the right, to change, modify, add, or remove portions of these Terms and Conditions of use at any time. Changes will be effective when posted on the Site with no other notice provided. Please check these Terms and Conditions of use regularly for updates. Your continued use of the Site following the posting of changes to these Terms and Conditions of use constitutes your acceptance of those changes.
“Account” means the HEBeauty360° Account that you will need to register for (OPTIONAL) on the Site if you would like to submit an Order on the Site;
“Business Day” means any day on which banks in Malaysia open for business;
“Order Confirmation” means our email to you, in which we acknowledge your Order. (Please refer to PLACING AN ORDER section for in depth info);
“Contract” means your Order of a Product or Products in accordance with these Terms and Conditions which we accept in accordance with clause 4.3 below.
“We/Us/Our” means HEBeauty360°.com which is operated by J Glitz Enterprise with registration number of 002282836-X;
“Customer” means any individual who places an Order on the Website;
“Order” means the Order submitted by you to the Website to purchase a Product from us;
“You/Your” means the customer who places an Order.
4. TERMS OF SALE
4.1 PLACING AN ORDER
To place an Order, you can choose to register with us by creating an Account on the Site or login as Guest. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorized user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. All prices advertised are subject to change. You must also keep your information up to date by informing us of any changes, by using the relevant sections of the Site.
4.2 USER SUBMISSION
Anything that you submit to the Site and/or provide to us, including but not limited to, questions, reviews, comments, and suggestions (collectively, "Submissions") will become our sole and exclusive property and shall not be returned to you.
In addition to the rights applicable to any Submission, when you post comments or reviews to the Site, you also grant us the right to use the name that you submit, in connection with such review, comment, or other content.
You shall not use a false e-mail address, pretend to be someone other than yourself or otherwise mislead us or third parties as to the origin of any Submissions. We may, but shall not be obligated to, remove or edit any Submissions.
4.3 FORMATION OF CONTRACT
To submit an Order, you will be required to follow the online shopping process on the Site. Please refer HERE. After that you will receive an Order Confirmation which will act as an acknowledgement of your Order.
An Order is only considered accepted by Us upon your Order being shipped to the delivery address provided by You.
4.4 ORDERS AND SPECIFICATIONS
All Orders are subject to acceptance by Us and are subject to availability. After placing an Order, You will receive an email from Us acknowledging that we have received Your Order. Please note that this does not mean that Your Order has been accepted.
Your Order constitutes an offer to Us to buy a Product. All Orders are subject to acceptance by Us and We will confirm such acceptance by dispatching You an email that confirms that the Product has been dispatched (the “Dispatch Notice”). The Contract between Us will only be formed when We send You the Dispatch Notice.
4.3 ORDER ACCEPTANCE AND PRICING
Please note that there are cases when an order cannot be processed for various reasons. The Site reserves the right to refuse or cancel any order for any reason at any given time. You may be asked to provide additional verifications or information, including but not limited to phone number and address, before we accept the order.
We are determined to provide the most accurate pricing information on the Site to our users; however, errors may still occur, such as cases when the price of an item is not displayed correctly on the website. As such, we reserve the right to refuse or cancel any order. In the event that an item is mispriced, we may, at our own discretion, either contact you for instructions or cancel your order and notify you of such cancellation. We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card or bank account charged.
The price of the Goods shall be the price stated in HEBeauty360’s website at the time which the Buyer makes its offer purchase to HEBeauty360. The price is inclusive of Goods and Services Tax but is exclusive of packaging costs and deliver charges which the buyer shall be liable to pay to HEBeauty360° in addition to the price.
GST is implemented in Malaysia with effect from 1 April 2015 at the rate of 6%. It will replace the existing sales tax and service tax. Prices of Items and services provided by J Glitz Enterprise, being GST registered company, will include GST where applicable.
Please refer to the GST Act 2014 published in the gazette on 19 June 2014 and the GST Regulations 2014 issued on 30 June 2014. GST is under the jurisdiction of the Royal Malaysian Customs Department (“Customs Department”).
5.1 We aim to deliver the Product to you at the place of delivery requested by you in your Order and the delivery time indicated by us at the time of your order checkout (as updated in the Order Confirmation).
5.2 We shall notify you if we expect to be unable to meet our estimated delivery date, but, to the extent permitted by law, we shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses arising out of late delivery.
5.3 Upon delivery of the Product, you may be required to sign for delivery. You may contact HEBeauty360° by clicking on the “CONTACT US” button on the Site. You shall be able to provide the documents delivered with the Product, upon request.
5.4 Please note that it might not be possible for us to deliver to some locations in which event, we will inform you using the contact details you provide to us when u make your Order and arrange for cancellation of the Order or delivery to an alternative delivery address.
5.5 We deliver in our standard packaging.
5.6 All risks in the Product shall pass to you at the time of delivery. From the time when risk passes to you, we will not be liable for loss or destruction of the Product. Any breach of obligations by you, might impact your ability to shop on HEBeauty360° in the future.
5.7 If you are not available to take delivery or collection you may contact contact 1300 300 300 pos laju (Courier Service) hotline for second time delivery.
5.8 If delivery or collection is delayed through your unreasonable reason/ refusal to accept delivery or if you do not (within one week of our first attempt to deliver the Product to you) accept delivery, we may (without affecting any other right or remedy available to us) do the following and Strictly NO REFUND of GOODS is allowed.
i) charge you for any fee and other costs reasonably incurred by us;
You acknowledge that the Products are standard and not bespoke to fit any particular requirements that you may have.
5.9 In event there exists a conflict of total cart size which entitle free shipping, the value on website shall prevail.
6. FAULTY PRODUCTS
6.1 All Product descriptions, information and materials posted on this Site are provided ‘as is’ and without warranties express, implied or otherwise howsoever arising.
6.2 Product image as seen on the Site may slightly differ from the actual Product that you receive.
6.3 If the item you receive is faulty, please contact our Customer Service Line and provide us your Order number, your name, and address, details of the Product and the reason for return, and whether you require a refund or a replacement.
6.4 Upon receipt of the Products, we will examine it and we will advise you on the status of the replacement or refund (if any) via email as soon as practicable.
6.5 HEBeauty360° may at its discretion refuse to process a replacement/exchange/refund for all tried/worn items.
6.6 In the event the Product returned is not faulty, we may at our discretion decide not to repair, replace or refund you for the Product and /or we may require you to pay all reasonable carriage costs and servicing costs at our current standard fees and costs and charge this to your credit or debit card, or payment details that you provided to us when you made your Order, and, to the extent permitted by law, we shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses as a result.
7. DISCLAIMER OF LIABILITY
The Website Owner shall not be responsible for and DISCLAIMS all liability for any loss, liability, damage (whether direct, indirect or consequential), personal injury or expense of any nature whatsoever which may be suffered by you or any third party (including your company), as a result of or which may be attributable, directly or indirectly, to your access and use of the website, any information contained on the website, your or your company's personal information or material and information transmitted over our system. In PARTICULAR, neither the Website Owner nor any third party or data or content provider shall be liable in any way to you or to any other person, firm or corporation whatsoever for any loss, liability, damage (whether direct or consequential), personal injury or expense of any nature whatsoever arising from any delays, inaccuracies, errors in, or omission of any share price information or the transmission thereof, or for any actions taken in reliance thereon or occasioned thereby or by reason of non-performance or interruption, or termination thereof.
8. CIRCUMSTANCES BEYOND OUR CONTROL (FORCE MAJEURE)
We shall not be liable to You for any breach, hindrance or delay in the performance of a Contract attributable to any cause beyond our reasonable control, including without limitation:
i) Strikes, lock-outs or other industrial action
ii) Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster.
iii) Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
iv) Impossibility of the use of public or private telecommunications network
v) The acts, decrees, legislation, regulations or restrictions of any government, shipping, postal or other relevant transport strike, failure or accidents.
9.1 Goods sold are not refurndable/returnable or exchangeable.
9.2 All our orders are checked to avoid any defects before shipping out. Kindly contact us at email@example.com within 48 hours after receiving your parcel for any manufacturing defect.
9.3 Returns and exchanges (for manufacturing defect) must be sent back within 7 days from the date of order is received. We accept exchange as long as the item purchased is not tried, not worn, not washed or not changed in any way.
9.4 The management of Hazel’s eBoutique reserves the rights to reject any returns at our sole discretion shall we find any goods returned in an altered / tried/ used condition.
